The regular meeting of the Ojai Planning Commission will be called to order by the Chair on Wednesday, September 5, 2007, at 7:30 p.m. in the Council Chambers of Ojai City Hall, 401 S. Ventura Street, Ojai, California.

APPEARING ON THE AGENDA ARE REQUESTED TO COMPLETE A SPEAKER'S CARD AND FILE IT WITH THE COMMISSION SECRETARY PRIOR TO THE START OF THE MEETING. PROJECT APPLICANTS WHO HAVE AN ITEM ON THE AGENDA DO NOT NEED A SPEAKER'S CARD. CARDS ARE AVAILABLE IN THE LOBBY OF THE COUNCIL CHAMBERS. ALL COMMENTS SHOULD BE LIMITED TO THREE MINUTES OR LESS UNLESS ADDITIONAL TIME IS GRANTED BY THE CHAIR.

PUBLIC COMMUNICATIONS
Public Communications is the time set-aside during the Planning Commission meeting for members of the public to address the Planning Commission on matters not on the agenda. Under State law, other than for emergency items, no action can be taken at this meeting. Matters raised at this time may be briefly discussed by the Commission, and will generally be referred to staff and/or placed on a subsequent agenda. Persons wishing to address the Planning Commission should fill out a speaker card. When addressing the Commission, please state your name and limit your comments to three
minutes or less. Thank you.
CONSENT CALENDAR – The consent calendar is approved by a roll call vote on one motion. Should any member of the Commission wish to discuss or disapprove an item, it must be removed from the consent calendar and considered as a separate item.

PUBLIC HEARING ITEM
2. DESIGN REVIEW PERMIT FOR AN EXTERIOR REMODEL, THE CONSTRUCTION OF A 6,251 SQUARE-FOOT LIVING AREA ADDITION, A 391 SQUARE-FOOT GARAGE ADDITION, AND 2,609 SQUARE-FOOT DECK AND OUTDOOR STAIRWAY ADDITION TO AN EXISTING TWO-STORY 3,934 SQUARE-FOOT SINGLE-FAMILY RESIDENCE WITH AN ATTACHED 614 SQUARE-FOOT GARAGE (DRP 07-09), AND A TREE PERMIT FOR THE REMOVAL OF THREE VALLEY OAK TREES (T 07-21) on the property located at 561 Saddle Lane in Ojai, California. Assessor’s Parcel Number 024-0-131-035. The General Plan designation for the property is Very Low Density Residential (VLR) and the Zoning Classification is Single-Family Residential, Very Low Density (R-O-4). This project is categorically exempt pursuant to the California
Environmental Quality Act. Property Owner/Applicant: Raul Alvarado. Representative: Marc Whitman, Whitman Architectural Design (CONTINUED FROM AUGUST 15, 2007).
RECOMMENDATION:
1. Adopt the required findings for Design Review Permit (DRP 07-09) and Tree Permit (T 07-21) as specified in Attachment A of the staff report, including CEQA findings;
2. Accept the CEQA Categorical Exemption for DRP 07-09 and T 07-21 included as Attachment B of the staff report; and
3. Approve DRP 07-09 and T 07-21 subject to the conditions included as Attachment C of the staff report.
3. DESIGN REVIEW PERMIT (DRP 07-11) FOR THE CONSTRUCTION OF A COVERED
PATIO TO ACCOMMODATE THE PREVIOUSLY APPROVED OUTDOOR DINING ON THE SOUTHWEST CORNER OF THE BUILDING FOR REGAL’S WINE & SPIRITS on the property located at 655 E. Ojai Avenue, Ojai, California, Assessor’s Parcel Number
023-0-142-170. The General Plan Designation is General Commercial (GC) and the Zoning Classification of the project site is General Commercial (C-1). This project is categorically exempt pursuant to the California Environmental Quality Act. Property Owner: Linda Koire. Applicants: Joby M. Yobe and Jorge Alem.
RECOMMENDATION:
1. Adopt the required findings for Design Review Permit (DRP 07-11) as specified in Attachment A of the staff report, including CEQA findings;
2. Accept the CEQA Categorical Exemption for DRP 07-11 included as Attachment B of the staff report; and
3. Approve DRP 07-11 subject to the conditions included as Attachment C of the staff report.
4. NEW ORDINANCE REGULATING FORMULA BUSINESSES IN THE CITY OF OJAI (TA 07-02). A Class 5 Categorical Exemption (Minor Alterations in Land Use
Limitations) has been prepared pursuant to the California Environmental Quality Act. Applicant: City of Ojai
RECOMMENDATION:
Adopt a Resolution recommending that the City Council:
1. Conduct a public hearing to receive public testimony on the amendments to the Zoning Ordinance, and environmental determination;
2. Adopt an Ordinance amending the Ojai Municipal Code adding Section 10-2.1713 (Formula Retail Establishments) and Renumbering Existing Section 10-2.1713 (Applicable Regulations) to Section 10-2.1714, Repealing Ordinance Number 794, and adopting CEQA Environmental Determination of Exemption.
